And neither I nor Jake are claiming ownership of nohands - he was a foster kitten and I have no idea who he belongs to now. The _photo_ of nohands, however, was definitely taken by Jake. And since he doesn't care how people use it, it's effectively in the public domain. But not because it was posted on a web site. _That's_ the point I'm trying to make. Internet != Public Domain.

Christ. If I can get the people who live in that apartment now to let me in and take a picture of the windowsill, would that prove anything? Or would people just claim that I'd faked it?

he could well have put a copyright notice on the original image when it first slipped onto the web. That doesn't stop somebody else from copying it and posting it somewhere like ratemykitten.

(I think nohands is overrated anyway - clive is far superior)

You don't have to put a copyright notice on something for it to be copyrighted. See www.bitlaw.com/copyright/obtaining.html for more information, particularly the "Automatic Creation" paragraph. Since 1978, a copyright notice has only been a formality, not actually required.

Where in my post did I tell anybody to stop using the picture? I pointed out that posting something to the internet is not the same thing as putting it in the public domain, and that resources exist for finding out how to get permission to use material in derivative works. I never said that anyone should stop using the image, because I know that the person who took the original photo doesn't care, and occasionally gets a kick out of seeing his kitten photo used in a good photoshop job or flash animation.
